Program Proposal
The policy, program, and budget of the current fiscal year 2079/080 approved by the eleventh session of the Kathmandu Metropolitan City Municipal Assembly includes organizing a National Conference of the Judicial Committee.
As stated in Serial No. 118 of the approved policy, the Kathmandu Metropolitan City will organize this national conference to facilitate the exchange of experiences in justice administration at the local level.
In the approved program budget, under the Department of Law and Human Rights (Serial No. 176), a budget allocation of Rs. 3 million has been made for the conference under Expenditure Code 22522.
1. Conference Date
The National Conference of the Judicial Committee will be held on Chaitra 15 and 16, 2079, at Pragya Bhawan, Kamaladi, Kathmandu.
2. Participants in the Conference
The following invitations will be made to participate in the Judicial Committee National Conference:
(a) Local Level Judicial Committees
One representative (either the coordinator or a member) from each of the 753 Judicial Committees across the country—designated by the respective committee—to ensure nationwide participation.
(b) Former Judicial Committee Officials
Approximately 10 individuals will be invited from among experienced and exemplary former Judicial Committee officials who served in previous terms but are not currently in office.
(c) Experts and Stakeholders
Around 30 participants from relevant national institutions and bodies, including
- Ministry of Federal Affairs and General Administration
- Ministry of Law, Justice, and Parliamentary Affairs
- Office of the Attorney General
- National Judicial Academy
- Human Rights Commission, Women's Commission, Nepal Police
- Bagmati Province ministries
- Good Governance Centers and other related offices
- Nepal Municipal Association
- Federation of Rural Municipalities
- Experts from universities and law campuses
- Mediators and legal practitioners
(d) Presenters and Commentators
Around 10 people will participate, including the paper presenter, commentators, and other assistants.
(e) Kathmandu Metropolitan City Representatives
Around 100 officials will participate, including
- Officials of the Judicial Committee of Kathmandu Metropolitan
- Chief Administrative Officer
- Officials of the Urban Planning Commission and department heads
- Employees of the Law and Human Rights Department
- Legal advisors, Ward Women Network coordinators, and Municipal Police.
In total, the participation is expected to include approximately 800 individuals. Relevant stakeholders will be identified and invited accordingly.
With the facilitation of the Government of Nepal, Ministry of Federal Affairs and General Administration, Provincial Governments, and District Coordination Committees, official communication will be sent to all local levels to ensure effective participation in the conference.
3. Theme and Working papers to be presented at the conference:
Working papers focusing on 4 main topics will be presented at the conference:
- The concept of the Judicial Committee, provisions related to the Judicial Committee in various laws, the jurisdiction of the Judicial Committee in the administration of justice, and its practice.
- Conciliation process and promotion of the Conciliation process in the resolution of local disputes.
- Judicial decisions to be made by the Judicial Committee and the procedures to be followed for this
- Ensuring the effective implementation of the agreements and decisions made through the Judicial Committee and the necessary institutional management for that.
4. General outline of the program
The program will be held for two days. The program venue, working paper presenters, commentators, program directors, etc. will be confirmed later.
Audio-visual materials related to the work of the Judicial Committee will be presented at the conference, and brochures related to the topic will also be prepared and distributed.
5. First day
Inaugural program: Starting at around 11 am.
Presentation of three working papers, including the opening session, group discussions, and preparation of group presentations.
Approximately 1.30 hours will be allocated for presentation, commenting, and discussion on each working paper.
The program will run until 5 pm.
6. Day 2—Group Work and Conclusion
The program will start with the presentation of one of the four working papers that remains to be presented at 8 am.
The presentation work will be completed by 11 am.
After all four working papers are presented, the participants will be divided into four groups and prepare presentations by focusing on the set questions and discussing them in groups.
The time for group presentations will be set at 30 minutes.
All presentations will be completed by approximately 3 pm.
The closing program will begin at approximately 3 pm.
7. Kathmandu Dispute Resolution Declaration, 2079
After the conference is concluded, the Kathmandu Dispute Resolution Declaration, 2079, which contains specific points and aims to guide judicial committees across the country, covering major issues.
8. Institutional Structure Management
A proposal will be presented to establish a Judicial Committee Network comprising
a. Judicial Committee National Network
A chairperson, a secretary, a treasurer, and five members will be elected from the conference in this network. Since the chairperson of the Judicial Committee Provincial Network elected from the Judicial Committee meeting held in each province will be the ex-officio vice-chairperson of this network, the Judicial Committee National Network will consist of 15 members, including seven vice-chairpersons.
b. Judicial Committee Provincial Network:
In this network, one chairperson, one secretary, one treasurer, and five members will be elected from the Judicial Committee meetings held in each province. Since the chairperson of the Judicial Committee District Network elected from the Judicial Committee meetings held in each district will be the ex-officio vice-chairperson of this network, a Judicial Committee Provincial Network will be formed with 14 members in Koshi Province, 8 in Madhesh Province, 13 in Bagmati Province, 11 in Gandaki Province, 12 in Lumbini Province, 10 in Karnali Province, and 9 vice-chairpersons in Sudur Paschim Province.
c. Judicial Committee District Network:
In this network, one chairperson, one vice-chairperson, one secretary, one treasurer, and one member each of the coordinators or members of the Judicial Committees of all other local levels within the district that are not represented in the office bearers will be members of this network.
The office bearers of the Judicial Committee National Network will be elected at the conference. After the conclusion of the conference of the National Network of Judicial Committees, the statute approved by the conference will be registered at the District Administration Office, Kathmandu, and the networks will be formed by organizing provincial and district meetings of the Judicial Committee as mentioned in the statute. The term of the network will be 5 years.
9. Publishing guidelines
The National Conference Guidelines of the Judicial Committee will be published, which will include the participants in the conference, all the working papers presented, the opinions presented during the discussions and the conclusions drawn from the working papers, the Kathmandu Dispute Resolution Declaration, conference-related photos, and other reference materials.
10. Forming thematic subcommittees and task forces
Since Kathmandu Metropolitan City has decided to hold a national-level conference of this kind for the first time, the main committee formed to organize the conference may form various thematic and sectoral subcommittees and task forces as needed to carry out the work.
The following achievements are expected from the National Conference of the Judicial Committee:
- Judicial Committees at all local levels will be more clear about the Judicial Committee, the jurisdiction of the Committee, the role of the Committee, and the laws related to the Committee.
- The Judicial Committee officials and stakeholders will be clearly informed that the Judicial Committee should resolve disputes through mediation as much as possible.
- The methods adopted by the Judicial Committee to resolve disputes will be clear about the mediation and decision-making process.
- The Judicial Committee officials and related employees will be clear about the overall procedure and legal process of justice delivery.
- The institutional structure of the national, provincial, and district-level network for exchanging good and successful experiences and practices of the Judicial Committee will be developed.
- It will help increase the access of the general public to justice delivered by 753 local levels across the country. It will help in the decentralization of justice, making justice faster, quicker, and more effective.
- Kathmandu Metropolitan City will be recognized as a leading local government that thinks, collaborates, and runs campaigns for all local levels and will be successful in clarifying its parental role for all local levels and will successfully implement its declared policies and programs.
11. Expected Achievements from the Conference:
The following achievements are expected from the National Conference of the Judicial Committee:
- Judicial Committees at all local levels will be more clear about the Judicial Committee, the jurisdiction of the Committee, the role of the Committee, and the laws related to the Committee.
- The Judicial Committee officials and stakeholders will be clearly informed that the Judicial Committee should resolve disputes through mediation as much as possible.
- The methods adopted by the Judicial Committee to resolve disputes will be clear about the mediation and decision-making process.
- The Judicial Committee officials and related employees will be clear about the overall procedure and legal process of justice delivery.
- The institutional structure of the national, provincial and district-level network for exchanging good and successful experiences and practices of the Judicial Committee will be developed.
- It will help increase the access of the general public to justice delivered by 753 local levels across the country. It will help in decentralization of justice, making justice faster, quicker and more effective.
- Kathmandu Metropolitan City will be recognized as a leading local government that thinks, collaborates, and runs campaigns for all local levels, and will succeed in clarifying its guardian role for all local levels, and will successfully implement its declared policies and programs.
12. Estimated cost of organizing the conference
It is estimated that about Rs. 5 million will be spent on the following headings to hold the conference. The Hotel Association of Nepal will also collaborate in this.
- Hotel expenses: Approximately Rs. 200,000 including one dinner, one lunch, one breakfast, one high tea, about five tea biscuits, hall rent for about 800 people
- Paper preparation: Approximately Rs. 100,000 including four paper preparations, presentations, and commentaries.
- Guest accommodation facilities: Approximately Rs. 3000 for two days for about 700 people, totaling Rs. 210,000
- Guide publication: Approximately Rs. 300,000 for writing, editing, and publishing the guide
- Stationery: Approximately Rs. 600 for all participants, totaling Rs. 500,000
- Request the officials of the Judicial Committee and other persons participating in the conference to bear their daily and travel allowances from the local level where they are serving.
Kathmandu Metropolitan City Judicial Committee National Conference Preparation Main Committee
On 25th Falgun 2079 BS, a meeting was held under the chairmanship of the Coordinator of the Judicial Committee National Conference Preparation Main Committee, Mr. Sunita Dangol, and the following decisions were made.

Decision No. 1.
The following work has progressed regarding the preparation of the Judicial Committee National Conference:
(a) A letter signed by the Coordinator of the Judicial Committee and the Coordinator of the Conference Preparation Main Committee, Deputy Chief Sunita Dangol, has been sent to the email addresses of all local levels to ensure the participation of all the Judicial Committees, i.e., all 753 local levels, in the Judicial Committee National Conference. The letter has been returned without being sent to the email addresses of some local levels. It was learned that work is underway with a plan to contact all local levels by telephone within this month, i.e., mid-Falgun. Additional staff will be mobilized to ensure participation by contacting them by telephone and collecting province-specific details, and further emphasis will be placed on ensuring the participation of all local-level judicial committees across the country in this first national conference of the Judicial Committee. The Invitation and Coordination Committee to be formed today will work for this.
(b) The work has progressed as follows:

To form the following thematic committees under the conference preparation main committee to carry out the following tasks in order to successfully complete the Judicial Committee National Conference to be held on Chaitra 15 and 16, 2079 in a manner that achieves the expected results.
1. Invitation and Coordination Committee

This committee will have to perform the following tasks for the National Conference of the Judicial Committee:
(a) To ensure participation by writing, rewriting, or telephonically contacting all local-level Judicial Committees for participation.
(b) To identify and invite officials and subject experts from the Government of Nepal, provincial governments, constitutional bodies, and universities who need to be invited to participate in the conference.
(c) To coordinate with dignitaries participating in the conference and provide necessary facilitation.
(d) Details of the officials and individuals participating in the conference shall be finalized and submitted to the main committee before Chaitra 10.
(e) To perform/cause other tasks assigned by the main committee.
2. Conference Management Committee

(c) To arrange/cause seating arrangements for the officials and dignitaries participating in the conference.
(d) To coordinate with the Welcome and Cultural Committee to arrange for the presentation of audiovisual and entertainment materials to be presented at the conference.
(e) To perform/have other tasks assigned by the main committee.
3. Publicity Committee

(a) To take maximum initiative to widely publicize the special importance of the Judicial Committee National Conference organized by Kathmandu Metropolitan City for the first time and to bring news about the achievements of the conference to light in all media outlets before, during, and after the conference.
(b) To make appropriate and necessary arrangements for the publicity of the conference, thematic sessions, group discussions and presentations, announcement programs, and closing sessions, including the priority of the media.
(c) To make arrangements for discussions with journalists, communication management, news dissemination, press releases, etc., regarding the conference.
(d) To make arrangements for brief interviews with officials and subject experts participating in the conference.
(e) To perform/make arrangements for other tasks assigned by the main committee.
4. Conference Material Production and Promotion Committee

This committee will have to perform the following tasks for the Judicial Committee National Conference:
(a) To coordinate and facilitate the production of audio-visual materials related to local dispute resolution, reconciliation, justice administration, and other important topics to be presented at the Judicial Committee National Conference.
(b) Finalize the working paper by discussing with subject experts on the topics to be presented at the conference, and conduct necessary discussions, coordination, and facilitation with the office bearers or experts for the commentary on the working paper and session chairmanship.
(c) Determine the materials to be distributed at the conference (bags, books, agenda, working papers, stationery, gifts, etc.) and provide them to the conference management committee.
(d) Make arrangements to produce audiovisual materials covering all aspects of the conference.
(e) Perform/have other tasks assigned by the main committee.
5. Food Arrangement Committee

This committee will have to perform the following tasks for the Judicial Committee National Conference:
(a) To determine the menu of food and snacks for the participants of the Judicial Committee National Conference, select the service provider and make appropriate arrangements for snacks and meals accordingly.
(b) To arrange/make arrangements for tea and biscuits between sessions and at appropriate times as per the agenda of the conference.
(c) To ensure/make provision for clean drinking water and healthy food at the conference.
(d) To manage food, snacks, and tea times; meal times and places to eat without disrupting the regular program of the conference; to obtain information about vegetarian, non-vegetarian, or fasting among the participants; and to make necessary arrangements accordingly.
(e) To perform/cause other tasks as assigned by the main committee.
6. Welcome and Entertainment Arrangements Committee

(b) To arrange for entertainment programs to be presented between sessions and at appropriate times as per the agenda of the conference and to coordinate and facilitate with the Conference Management Committee.
(c) To provide support and necessary coordination to conduct the conference in a memorable environment.
(d) To make necessary arrangements for the participants to be treated respectfully after the conference is concluded.
(e) To perform/cause other tasks as assigned by the main committee.
7. Budget and Expenditure Management Committee

This committee shall perform the following tasks for the Judicial Committee National Conference:
(a) To determine the process of spending the budget allocated for the Judicial Committee National Conference and to coordinate, support, and facilitate the decision of the authorized officer to spend it.
(b) To determine the expenses to be incurred in the program as per the agenda of the conference and to provide opinions and suggestions in this regard.
(c) To arrange the necessary budget for the conference.
(d) To make arrangements to distribute the prescribed amount for remuneration or accommodation facilities to the conference's working paper presenters, commentators, session chairpersons, participants, and service providers.
(e) To perform/have other tasks prescribed by the main committee.
8. Records and Reports Committee

This committee will have to perform the following tasks for the Judicial Committee National Conference:
(a) Update the details of the participants of the Judicial Committee National Conference at the provincial, district, and local levels and make arrangements for their attendance accordingly.
(b) Prepare the details of the officials who will participate in the group discussions to be held in the 4 groups on the thematic working paper as per the agenda of the conference and make arrangements for the discussions, and facilitate the necessary arrangements for the group presentations.
(c) To make arrangements to keep a proper video record of the speeches of the chief guest and guests at the opening and closing ceremonies of the conference, the views, opinions and presentations of the experts, commentators, session chairmen, and participants during the discussions, and to make necessary coordination for this.
(d) To prepare and provide hard and digital copies of the complete report with the necessary information and messages for the Judicial Committee National Conference.
(e) To perform/have other tasks assigned by the main committee.
Decision No. 3.
(a) To invite the Honorable Chief Justice or the Minister of Law, Justice, and Parliamentary Affairs of the Government of Nepal or the Minister of Federal Affairs and General Administration as the chief guest at the opening and closing sessions of the conference.
(b) The relevant committee will work on the issues of event management, food management, etc.
